Article 15 of Decree 1023/94 includes, among the categories under which the National Migration Directorate (Direccion Nacional de Migraciones, DNM) may grant temporary or permanent residence to persons who meet the general requirements set out in the migration regulations, two special considerations [translation]: k) "those born in countries for which special consideration is granted by law of a higher legal standing than an executive decree"; and ll) "foreigners from countries which, due to geographic, historic, economic and other reasons, can justify, in the opinion of the Ministry of the Interior, special consideration" (tratamiento especial) (Argentina 16 Feb. 2000). The DNM indicates that it is the Ministry of the Interior that defines who is to be covered by these considerations of article 15 (ibid. 29 July 1994). (Please note that the DNM is a branch of the Ministry of the Interior).
No references to Eastern European countries being included by the Ministry of the Interior for special consideration in accordance with article 15 could be found among the sources consulted by the Research Directorate.
Argentina reportedly signed, on 29 April 1999, a bilateral agreement on migration with Ukraine, which came into force in November 2001 (Argentina 15 Jan. 2003). However, a copy of the text, or details on the content of the agreement, could not be obtained within the constraints of this Response. The electronic database of the Senate of Argentina indicates that the text of the Argentine law implementing the agreement has not been archived yet (ibid. 20 Jan. 2003). However, an Argentine newspaper, referring to the agreement, stated that it enables citizens of either, country who hold an entry permit issued by the other country in accordance with legislation, to enter that country and enjoy the status of temporary resident for one year (La Mañana del Sur 26 Jan. 2001).
