As indicated in Response to Information Request ESP26629.E of 29 April 1997 which references statements provided by the Embassy of Spain in Ottawa, refugee status is not automatically lost by a person who leaves Spain for more than one year (28 Apr. 1997). As established by law, a refugee can only lose this status when he or she willingly obtains the protection of his or her own country (país de su nacionalidad) or when he or she has willingly settled in another country and that country has assumed responsibility for the individual (ibid.).

This Response was prepared after researching publicly accessible information currently available to the DIRB within time constraints. This Response is not, and does not purport to be, conclusive as to the merit of any particular claim to refugee status or asylum.
