The information that follows was provided during a 31 October 1997 telephone interview with an information officer of the Sexual Crimes Brigade of the Investigations Police in Valaparaiso.
A victim of rape or sexual violence or their representative can report the crime to the police, regardless of the occupation or position of the alleged victimizer(s). The police will also carry out the investigation regardless of the occupation or position of the alleged attacker(s). If the crime was committed by a member or members of the military, the prosecution is carried out by the military attorneys and courts once the Investigations Police have concluded the investigation of the crime.
Statistics on the number of reported cases of sexual crimes committed by military personnel and their rate of conviction since the return to democracy could not be found among the sources consulted by the Research Directorate within the time constraints of this Response to Information Request.
This Response was prepared after researching publicly accessible information currently available to the Research Directorate within time constraints. This Response is not, and does not purport to be, conclusive as to the merit of any particular claim to refugee status or asylum.
