Czechoslovakia: Articles 109 and 112 of the Czechoslovakian Penal Code

Although a copy of the full texts of the requested articles could not be found among the sources currently available to the IRBDC, two Amnesty International documents refer to them. One of the documents describes article 109 as follows: [ The imprisonment of persons seeking to leave a country or return to their own country, (London: Amnesty International, 1986), p. 8.]

"Article 109 (Paragraph 1) of the penal code of the Czechoslovak Socialist Republic (CSSR) provides: "Whoever leaves the territory of the Republic without permission shall be punished by imprisonment for a term of six months to five years, by reformatory measure or by forfeiture of property". Paragraph 2 states that "the same punishment shall be imposed on a Czechoslovak citizen who stays abroad without permission".

Paragraph 3 of the same article imposes penalties of imprisonment of three to ten years for certain other acts including organizing the acts in paragraphs 1 and 2 or taking across the frontier a group of persons who are leaving without permission."

In Czechoslovakia: Amnesty International Country Briefing, (London: Amnesty International, 1977), p. 7, article 112 is published as follows:

"Article 112. Damaging the Interests of the Republic

A Czechoslovak citizen or a stateless person resident within the territory of the Republic who damages the interests of the Republic through disseminating or aiding the dissemination of reports about conditions in the Republic which are untrue shall be punished by up to three and a half years' forfeiture of liberty."
