The World Human Rights Guide indicates that the practice of homosexuality between consenting adults is lawful in Brazil; however, no soliciting is allowed (1986, 41). The New State of the World Atlas also indicates that homosexuality was lawfull and tolerated in 1986 (1987, No. 55).

The United Press International (UPI) reported on 12 February 1992 that twenty-three officers of the Brazilian air force were facing court martials for allegedly participating in homosexual activities on a Rio de Janeiro air base. The defendants will be tried under the article 235 of the military penal code, which states, as quoted in UPI, that

the practice of or the military allowing the practice of libidinous acts, homosexual or not, in a place subject to military administration will be sanctioned with two months to a year in detention (Ibid.).
