Hungary: Identity cards and address cards for nationals and non-nationals, including requirements and procedures to obtain the cards; description of the cards, including information included on the cards.

1. Overview of the Identity Card

In correspondence with the Research Directorate, the head of the Central Office for Administrative and Electronic Public Services of Hungary stated that there are two types of identity cards: the personal identity card (permanent) and the temporary identity card (Hungary 23 June 2015). He explained that the personal identity card, Személyazonosító Igazolvány, is the same as the national identity card (ibid.).

In correspondence with the Research Directorate, an official at the Embassy of Hungary in Ottawa provided the following information on the permanent and temporary identity card, which he received from the Ministry of Interior (Belügyminisztérium) of Hungary: "[t]he identity card is a certified public document, which authentically proves the identity of the bearer and the personal data stored in the Hungarian central civil registry as foreseen by Act LXVI of 1992 on Keeping Records on the Personal Data and Address of Citizens" (ibid. 29 June 2015). According to the website of Hungary's Office of Immigration and Nationality, the identity card may be used to verify Hungarian citizenship (Hungary 15 Jan. 2014).

1.1 Format of the Identity Card

The Council of the European Union's Public Register of Authentic Identity and Travel Documents Online (PRADO), a site that provides information on the appearance, validity and features of authentic identity and travel documents in a given country (EU n.d.p), provides samples of the identity card, which establishes identity and is issued to nationals of Hungary (EU n.d.j). The PRADO site also provides samples of the residence document, which establishes identity and nationality and grants authorization to reside in Hungary (EU n.d.n). Information on the appearance, validity, legal status and contents of different versions of these cards can be found in Note [1] and samples of some of the cards are attached to this Response (Attachments 1-9).

1.2 Application Procedures for the Identity Card, Requirements and Procedures to Obtain an Identity Card

The website of the Central Office for Administrative and Electronic Public Services of Hungary provides the following information regarding the requirements and procedures to obtain the Personal Identity Card (hereafter referred to as the identity card) (Hungary n.d.a):

The identity card is mandatory for immigrants, "settled persons," refugees, and foreign citizens with "protected legal status (beneficiaries of subsidiary protection)." The identity card is also mandatory for "Hungarian citizens living in the territory of Hungary who do not have any valid passport or card format driving licence." Other Hungarian nationals who have a valid passport or card format driving licence are entitled to the card, although it is not mandatory.

The identity card can be applied for in any district office. If the applicant is a settled person, a recognized refugee, a foreign citizen with protected legal status, he/she must apply for the first issuance of the identity card in the immigration office or with the asylum authority upon receipt of his/her legal status. An identity card for new-borns who are citizens of Hungary (and born in Hungary) can be applied for by the legal representative in the maternity clinic or hospital through the registrar. A proxy is permissible should applicants be unable to present themselves personally due to health reasons, involuntary detention, or in cases of applicants lacking legal capacity, such as applicants who are under the age of 14. Alternatively, the applicants in the aforementioned situations may submit their applications to the "competent Municipality Clerk of the self-government of his/her registered place of domicile or place of residence." For those imprisoned or under involuntary treatment in a mental institution, the application can be submitted to the "competent district office of the place of detention."

The applicant must present an identity document such as a passport or card format driving licence which is still valid or has expired within one year. If the aforementioned identity documents are not available, the applicant must present an official document "appropriate for determining 'name bearing'" such as a birth certificate, marriage certificate or doctors degree, for example. In the case of a returning Hungarian national who intends to settle in Hungary, he/she must present the "Official Certificate on the Personal Identifier and Address of Domicile."

In the case of individuals who are recognized as refugees, foreign citizens with protected legal status and settled persons, they must present the document or permit that certifies the recognition of their legal status as well as the "Official Certificate on the Personal Identifier and Address of Domicile."

In the case of an applicant who is imprisoned or being detained involuntarily, an acting proxy is able to provide an authorization letter and the applicant's valid identity document. The acting proxy must also provide a photo of the applicant and a statement from the authority who ordered the detention, certifying that the photo and signature are in fact those of the applicant.

In the case of a minor, the acting legal representative must present the following documentation:

his/her identity card or any other valid identity document (passport, card format driving licence)

minor's birth certificate if he/she does not have valid passport (with the view to the ex[c]eptions of legislation and Hungarian new born citizens)

an ID card photo of the minor under 14 years of age must be attached if the application will be submitted to the competent Municipality Clerk of the self-government of his/her registered place of domicile or place of residence.

In the case of an applicant who is under guardianship for reasons other than legal capacity, the following documents must be attached:

birth certificate (with a view to the ex[c]eptions set forth in the legislation),

legally binding court decision certifying the guardianship,

the legally binding decision of guardianship authority certifying the legal representation,

the legal representative's ID document.

With the exception of persons unable to physically present themselves at the district office, all other applicants will have their photo taken at the district office, acting immigration office or asylum authority.

The identity card will be ready within 20 days and can be obtained by the applicant either in the district office or by mail, depending on the applicant's preference (ibid.).

According to the Head of the Central Office for Administrative and Electronic Public Services of Hungary, the "temporary identity card is issued immediately by [the] District Office" (Hungary 23 June 2015).

The same source provided the following information regarding validity periods:

The validity period is age-dependent:

age: 0-6 years - validity period: 3 years,

age: 6-14 years - validity period ends: the day of 14 birthday,

age: 14-18 years - validity period: 8 years,

age: 18-65 years - validity period: 10 years,

age over 65 years - without validity period.

The validity period of the temporary identity card is 30 days or 120 days. (ibid.)

2. Overview of the Address Card

According to the information provided by the Ministry of Interior to the embassy official, the address card is issued as a means of providing individuals with authentic proof of their personal identification number and registered address (Hungary 29 June 2015).

2.1 Format of Address Card

According to the embassy official, the address card is produced in a standard format, regardless of the region or the date of issuance (ibid.). Information on the appearance of the address card can be found in Note [1] under document code HUN-HO-10001.

2.2 Requirements and Procedures to Obtain an Address Card

According to the embassy official, persons eligible to receive an address card include the following:

Hungarian citizens living in Hungary and abroad.

In case they reside in Hungary:

immigrated third-country nationals (i.e. foreigners who are not citizens of the European Union, the countries of the European Economic Area or Switzerland, and are not family members of such persons)

settled third-country nationals

persons who are recognized refugees

persons under subsidiary protection

persons enjoying the right of free movement and residence (i.e. foreigners who are citizens of the European Union, the countries of the European Economic Area or Switzerland, or are family members of such persons). (Hungary 29 June 2014)

The same source provided the following information regarding application submission:

The address card is issued ex officio for the first time by the civil registrar (in case of newborns), by the immigration office (in case of foreigners), by the district office, or in case of Hungarian citizens living abroad, by the office of nationality (Bevándorlási és Állampolgársági Hivatal) when verifying their Hungarian citizenship or by the civil registrar when registering their vital statistics events which happened abroad.

The application shall be lodged at the municipal notary or the district office which has competence according to the location of the accommodation. Hungarian citizens living abroad may request the address card at the consul or at the Central Office (KEKKH) in Budapest. (ibid.)

The embassy official also provided the following information on the accompanying documents required to obtain an address card:

A valid identity document (identity card, passport or driver's licence)

A standard application form

The application shall be signed by the person registering his/her address and the person who provides the accommodation. The consent of the latter person is not necessary if the person registering his/her address has sufficient documentary proof that he is entitled to use the premises.

For foreigners, document proving their status in Hungary. (ibid.)

According to the embassy official, depending on the applicant's preference, the address card may be mailed to the applicant or the applicant may obtain the card in person at the district office (ibid.). The same source indicated that the card is typically issued right away, or, if this is not possible, within 21 days (ibid.).

With regard to the validity period, the embassy official indicated that, "there is no set validity date. If the address becomes invalid (fictive), the municipal notary invalidates the card in the central civil registry" (ibid.). The same source added that the address card is not renewable (ibid.).
