I GENERAL PROVISIONS
1. The Illuka Reception Centre for Asylum Seekers (hereafter called "the Reception Centre") is a state agency in the area of administration of the Ministry of Social Affairs, the duty of which is to provide necessary services to asylum applicants to organise the provision of these services.
2. The official title of the Reception Centre is:
in Estonian - Illuka Varjupaigataotlejate Vastuvotukeskus;
in English - Illuka, Reception Centre for Asylum Seekers.
3. The Reception Centre has its own seal, budget, bank account and symbols.
4. The Ministry of Social Affairs is a superior body of the Reception Centre.
5. The Reception Centre locates in Jaama village of Illuka, municipality in the county of Ida-Virumaa. The postal address of the Reception Centre is: EE2035, Ida-Viru Maakond, Kuremäe sidejaoskond, Illuka vald.
6. The Statute of the Reception Centre shall be affirmed and amended by the Minister of Social Affairs.
7. The Reception Centre shall perform its activities pursuant to the Constitution of the Republic of Estonia, its laws, regulations and administrative provisions, as well as according to this Statute.
II OPERATING AREA AND TASKS OF THE RECEPTION CENTRE
8. The aim of the activities of the Reception Centre is to guarantee the care of asylum applicants dependent on their age and state; to provide medical assistance and to organise their rehabilitation and accommodation.
9. Proceeding from its objectives the tasks of the Reception Centre are:
9.1 the organisation of temporary accommodation for the asylum applicants who have been transferred to the Reception Centre by the Citizenship and Migration Board and the Board of the Border Guard;
9.2 the issue, exchange and revocation of the certificate of an asylum applicant;
9.3 catering for asylum applicants and providing them with essential clothing and other necessities;
9.4 the provision of asylum applicants with money for urgent small expenses within the limits established by the Government of the Republic;
9.5 arranging of first aid and medical examination;
9.6 organising essential translation services;
9.7 organising Estonian language instruction;
9.8 informing asylum applicants about their rights and obligations;
9.9 ensuring the normal development of children staying in the Reception Centre;
9.10 organising advisory services on legal, psychological, health and other matters;
9.11 arranging other essential services.
10. In case the necessary conditions do not exist for offering essential services, the Reception Centre shall organise these services through other persons or institutions.
11. An asylum applicant staying in the Reception Centre can be, on the basis of the decision of the director of the Reception Centre or his/her deputy, separated from other persons staying in the Reception Centre, if he/she is dangerous to himself/herself or to others, but for no longer than 24 hours. The separated person must be under the constant surveillance of an employee of the Reception Centre.
12. By the consent of an asylum applicant he or she can be used for the housework of the Reception Centre:
13. An asylum applicant is entitled to the services provided by the Reception Centre until he or she is granted asylum or until he or she has left Estonia or been expelled from Estonia.
III. ADMINISTRATION OF THE RECEPTION CENTRE
14. The Reception Centre shall be administered by the Director of the Reception Centre who shall be appointed and dismissed by the Minister of Social Affairs.
15. The Director of the Reception Centre must have a higher education and he/she cannot be punished for any deliberate crime.
16. The Director of the Reception Centre shall:
16.1 submit the organisation of the Reception Centre and the composition of its staff to the Minister of Social Affairs for him or her to affirm;
16.2 affirm the rules and regulations, job descriptions and the rules of procedure of the Reception Centre;
16.3 conclude and terminate the contracts of employment with the employees of the Reception Centre, apply incentives and penalise them with disciplinary punishment;
16.4 within the range of his/her authority sign decrees pursuant to laws and to implement them, as well as give oral and written orders which are obligatory for employees;
16.5 prepare the budget of the Reception Centre and submit it to the Minister of Social Affairs
16.6 conclude contracts on behalf of the Reception Centre;
16.7 decide over matters concerning public property in the hands of the Reception Centre according to legislation in force and according to this Statute;
16.8 represent the Reception Centre in every state and local authority institution and, in relations with physical and legal persons within the letter of authorisation;
16.9 issue letters of authorisation to represent the Reception Centre and open accounts with banks according to the order provided for in laws;
16.10 perform other tasks connected with the administration of the Reception Centre or as given by the Minister of Social Affairs.
17. The Director of the Reception Centre shall be entitled to make proposals to the Ministry of Social Affairs to improve the activities of the Reception Centre.
18. The different spheres of activities of the Reception Centre shall be directed by senior specialists. Permanent structural units shall not be formed to perform the tasks of the Reception Centre.
IV. FINANCE AND AUDIT OF THE RECEPTION CENTRE
19. The Reception Centre shall keep financial and statistical records according to the procedure established by laws, regulations and other administrative provisions. The Reception Centre shall report to the Ministry of Social Affairs, which directs and co-ordinates its activities and implements the surveillance provided for by law.
20. The expenses of the Reception Centre shall be covered from the state budget.
21. The use of resources allocated from the state budget shall be controlled according to the procedure provided for by law.
V. REDEVELOPMENT AND LIQUIDATION OF THE RECEPTION CENTRE
22. The foundation, redevelopment and liquidation of the Reception Centre shall be carried out by the Government of the Republic.
