Germany: Berlin Administrative Court grants visa to Afghan national who worked for federal organisation

On 25 August 2021, the Administrative Court of Berlin decided in an urgent procedure to grant visas to the family of an Afghan national who worked for the German Society of International Cooperation (GIZ) until 2017. Their request for admission to Germany was earlier rejected on the ground that his mission with the GIZ had already ended in 2017.
 
The applicant applied to the Court for urgent legal protection, claiming that he and his family were in danger because of his previous cooperation with an international organisation and stated that the Taliban were looking for him. The Administrative Court of Berlin granted the urgent request in light of the ongoing situation in Afghanistan since the Taliban's takeover of power and the resulting danger to local forces. It stated that German authorities have recently changed the admission criteria for local staff to encompass former local employees and their families if their activities had lasted at least until 2013. It also found that adult children of local staff were encompassed in the new admission practice of the Federal Minister of Development.
