The attached letter in French which was sent by fax to the Research Directorate by the Algerian embassy states that, by virtue of Article 7 (1) of the 15 December 1970 Nationality Code, Algerian nationality by birth on Algerian soil is only granted to a child born to unknown parents. The letter also states that, in accordance with article 10 (1) of the Algerian Nationality Code, a foreigner can acquire Algerian nationality after at least seven years of residence in Algeria from the day of his/her application.

Please note that the Nationality Code, in its version released in 1994 by the Algerian Ministry of Justice, is available in French in the UNHCR legal databases (REFWORLD/REFLEG).

This Response was prepared after researching publicly accessible information currently available to the Research Directorate within time constraints. This Response is not, and does not purport to be, conclusive as to the merit of any particular claim to refugee status or asylum.
