Further to Response to Information Request ECU5098 of 16 May 1990 and other responses on Ecuadorean travel documentation, please find attached copies of an official translation of the Ecuadorean Travel Documents Act and Regulations and the Regulations Pursuant to the Travel Documents Act, prepared by the Multilingual Translation Directorate of the Deparment of Public Works and Government Services Canada. Both documents were originally issued in 1994 and provided to the DIRB in their original Spanish-language text by the embassy of Ecuador in Ottawa in June 1995. The Regulations Pursuant to the Travel Documents Act describes under Chapter IV, "Special Travel Document (Blue Passport)," the users, application and requirements for obtaining, and term of validity of the special travel documents (pp. 16-17). Under "term," article 27 of the document states that "this document shall be valid for one year and may be renewed for four periods of equal length" (17). The attached documents provide additional information on conditions that can render an Ecuadorean travel document invalid, among other things.

The conditions under which a Convention refugee can lose refugee status are established in article 4 of Decree No. 23293 of 30 September 1987 ("Reglamento para la aplicacion en el Ecuador de las normas contenidas en la convencion de 1951 sobre el estatuto de los refugiados y en su protocolo de 1967"). The document is available in Spanish in the United Nations High Commissioner for Refugees (UNHCR) database, available through the IRB network or at your Regional Documentation Centre. However, an official translation of the document is not currently available to the DIRB. For your reference, Article 4 of the document describes the circumstances in which a refugee ceases to be recognized as such by the Ecuadorean state. The description includes a reference to the cessation and exclusion clauses contained in the 1951 Convention. The document also establishes grounds for expulsion, legal avenues for decisions and appeals on refugee-related matters, as well as entry, residence and documentation issues, among others.

This Response was prepared after researching publicly accessible information currently available to the DIRB within time constraints. This Response is not, and does not purport to be, conclusive as to the merit of any particular claim to refugee status or asylum.
