Said v. Canada (Minister of Employment and Immigration)
The applicant, a citizen of Kenya, was denied refugee status because it was held that there was no credible basis for his claim. Subsequently, the Minister of Employment and Immigration ordered a review of the unsuccessful refugee claims of individuals from Kenya to determine if they qualified for landing on compassionate and humanitarian grounds. If the claim had been rejected as having no credible basis, so that the refugee claimant had not been entitled to a hearing on the merits, the file would be reviewed to see if compassionate and humanitarian grounds existed, but claimants were not notified of the review.
