According to the attached 15 October 1997 fax sent by the Embassy of the Republic of the Philippines in Ottawa, a divorce between Filipino citizens is not recognized by the Filipino government, regardless of where it is obtained and solemnised. The fax from the Embassy of the Philippines also states, however, that according to Article 26 of the Family Code, "where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the alien spouse capacitating him/her to remarry, the Filipino spouse shall likewise have the capacity to remarry under Philippine laws" (15 Oct. 1997).
