Instrument Constituting the Council of Ministers of Foreign Affairs of the Adean Group

Article 1

The Council of Ministers of Foreign Affairs of the countries of the Andean Group is hereby constituted, which shall hereafter be denominated the Andean Council.

Article 2

The Andean Council shall be composed of the Ministers of Foreign Affairs of the member countries of the Cartagena Agreement.

Article 3

The Andean Council shall undertake the following functions:

a) Formulate the joint foreign policy of the members countries;

b) Orient and coordinate, when appropriate, the external actions of the various bodies of the Andean system;

c) Contribute to the formulation of the general policy of the subregional integration process and recommend measures which assure the fulfillment of its goals and objectives;

d) Determine the means for executing the actions of the joint foreign policy, as well as decide the most appropriate levels of coordination and consultation to assure its full effectiveness;

e) Recommend to the Heads of State of the member countries the convocation of meetings when, in their judgment, circumstances so warrant, and prepare such meetings;

f) Request information and support from the pertinent bodies of the international Andean instruments;

g) Authorize the presence of special invitees at its meetings; and

h) Issue its own regulations.

Article 4

The Andean Council shall meet whenever the parties deem it necessary and, in any event, at least twice a year.

The Andean Council may invite in special cases ministers responsible for areas other than foreign affairs in the respective countries, in order to hear their opinions regarding specific matters.

Article 5

The Ministers of Foreign Affairs may meet as the Andean Council when they attend international events.

Article 6

The Andean Council shall be presided by the Minister of Foreign Affairs of the member country which is the site of the meeting, who shall continue to preside the Council until the next meeting in another member country.

Article 7

In the fulfillment of its functions the Andean Council may issue declarations, agreements, resolutions or recommendations, as may be appropriate. These acts of the Andean Council shall be adopted by consensus.

Article 8

The Ministers of Foreign Affairs of such countries as the Heads of State of the Andean Group have, by agreement, so designated may participate in the meetings of the Andean Council as observers.

Likewise, the Ministers of Foreign Affairs of other countries may participate in a specific session as invitees when so decided by the Andean Council.

Article 9

This instrument may be denounced by any member country by means of a written communication directed to the depositary country, which shall immediately so inform the remaining member countries. As of the date of the communication the effects of this instrument shall thereupon cease for said country. The denunciation of the Cartagena Agreement shall signify the denunciation of this instrument.

Article 10

The present instrument, which is subscribed by decision of the Presidents of the member states as manifested in the Mandate of Cartagena and in the Act of Panama, shall enter into effect once it has been signed by the plenipotentiaries of the five Andean countries and on the date mutually agreed upon.
