In Mexico, several senators have proposed in recent years national legislation addressing internal displacement, including laws on internal displacement as well as specific provisions such as the suggestion to include a paragraph on the protection of the IDPs in Mexico’s Constitution – suggestion that was rejected in 2004, or in the “General Law for Victims” that was passed in December 2012 (IDMC 2013). In 2016, the National Commission for Human Rights (Comisión Nacional de los Derechos Humanos – CNDH) suggested a revision of this law to correct the restrictions in the identification of the IDPs. More importantly, with the “Informe especial sobre desplazamiento forzado interno en México”, the CNDH invited the Congress to consider the adoption of a general law specifically on internal displacement (Cámara de Diputados 2016). The CNDH has developed the “Ley Federal para Prevenir, Atender y Reparar el Desplazamiento Forzado Interno” which was introduced to the Senate in April 2018, and sent to the Commissions of Human Rights and Legislative Studies (“Comisiones de Derechos Humanos y de Estudios Legislativos”) (Senado 2018). In addition, at the subnational level, the state of Chihuahua has launched recently with the help of different NGOs, a research project to gather evidence on internal displacement. The objective of the study is to develop a law on internal displacement at the state level.
