Law 9.474/17 is one of the main instruments for the national protection of refugees in Brazil. In addition, the resolutions of CONARE also regulate the situation of refugees and asylum seekers in the country.

Law nº 9.474/97

The new Migration Law 13.445/17 was sanctioned on May 24, 2017 and came into force in Brazil on November 21 of that year, after the publication of Decree Nº 9199/17, which regulated it . This law provides the rights and duties of the migrant and the visitor, regulates their entry and stay in the country and establishes principles and guidelines for public policies for the emigrant. In addition, the law defines and regulates the situation of stateless persons in the country, specifically referring to situations of statelessness in articles 1, 14, 26 (section “Protection of Stateless Persons and Reduction of Statelessness”), 30, 46 and 52 .

The Interministerial Ordinance No. 5 was published on February 28, 2018. The document regulates the procedure for recognizing the condition of statelessness and facilitated naturalization.
