This is the decision of the Supreme Court on the reference to it by the President of section 5 and section 10 of the Illegal Immigrants (Trafficking) Bill 1999 (hereafter "the Bill") pronounced pursuant to Article 26, s.2, subsection 1 of the Constitution. The decision of the court is that, for the reasons stated, none of the provisions of s.5 or s.10 of the Bill is repugnant to the Constitution.
