Comments The text of the Convention was unanimously adopted by the General Assembly on 13 April 2005. It is the thirteenth convention designed to combat terrorism, and is the first one adopted by the General Assembly since the terrorist attacks of September 11, 2001. The document will be opened by the Secretary-General for signature at United Nations Headquarters in New York on 14 September 2005. Article 3 provides that the Convention shall not apply where the offense is committed within a single State, the alleged offender and the victims are nationals of that State, the alleged offender is found in the territory of that State and no other State has a basis under other provisions of the Convention to exercise jurisdiction. Article 4(2) provides that "[t]he activities of armed forces during an armed conflict, as those terms are understood under international humanitarian law, which are governed by that law are not governed by this Convention, and the activities undertaken by the military forces of a State in the exercise of their official duties, inasmuch as they are governed by other rules of international law, are not governed by this Convention." Article 4(4) also notes that the Convention is not designed to address the issue of the legality of the use or threat of use of nuclear weapons by States. Articles 5 and 6 provide for the measures each State Party is to adopt including the establishment of criminal offenses under its national laws.
