In the Matter of Article 26 of the Constitution and Section 5 and Section 10 of the Illegal Immigrants (Trafficking) Bill 1999

Judgment of the Court delivered on the 28th day of August 2000 by Keane C.J. This is the decision of the Supreme Court on the reference to it by the President of section 5 and section 10 of the Illegal Immigrants (Trafficking) Bill 1999 (hereafter "the Bill") pronounced pursuant to Article 26, s.2, subsection 1 of the Constitution. The decision of the court is that, for the reasons stated, none of the provisions of s.5 or s.10 of the Bill is repugnant to the Constitution.
