In accordance with the provision 5 of article 6 of the "Law on Political Asylum" of the Republic of Armenia the Government of the Republic of Armenia decides:

1. To approve the sample application form for political asylum status in the Republic of Armenia, the list of documents to be attached to it and the procedure of preparation and management of the case-files according to the annexes 1, 2 and 3.

2. The given decision enters into force on the following day after the official publication.

PROCEDURE OF PREPARATION AND MANAGEMENT OF THE CASE-FILES FOR POLITICAL ASYLUM STATUS IN THE REPUBLIC OF ARMENIA

1. The given procedure is approved by the provision 5 of article 6 of the "Law on Political Asylum" of the Republic of Armenia and determines the procedure of applying to the Department of Migration and Refugees under the Government of the Republic of Armenia (hereafter the Department) and the procedure of preparation and management of case-files opened in the Department.

2. On the basis of the application form (approved by the Governmental Decision #232-N (03/04/2003)) of a foreign citizen for political asylum status in the Republic of Armenia a personal case-file is opened and prepared in the Department.

3. The process of preparation and management of a personal file is being organized by the head of the Department or his deputy.

4. Within the 5-day period after the acceptance of the application for political asylum, the documents to be attached to according to the procedure established by the Department, the head of the Department or his deputy conducts an interview with the political asylum-seeker (hereafter asylum-seeker) to clear up the conditions under which the asylum-seeker left the country of his/her nationality or permanent residence and applied for political asylum in the Republic of Armenia.

5. The interview is conducted in the temporary dwelling granted to the asylum-seeker in accordance with the established procedure or in the Department. The asylum-seeker is informed about the day and the place of the interview in advance.
A declaration is composed on the results of the interview.

6. With the purpose of conducing necessary investigation on each case the Department asks the National Security Service under the Government of the Republic of Armenia, the Police of the Republic of Armenia under the Government of the Republic of Armenia and the Ministry of Foreign Affairs of the Republic of Armenia for their conclusion on granting the asylum-seeker political asylum. Within a month after getting the conclusions of the authorized state bodies the head of the Department or his deputy summarizes the results of the interview conducted with the asylum-seeker and on the basis of the received conclusions prepares and presents to the president of the Republic of Armenia the proposal on granting the asylum-seeker political asylum.

7. The proposal consists of the preamble, descriptive and explanatory parts and the conclusion.
The preamble should contain information on the name of the body that prepared the proposal, as well as the name, family name, patronymic, nationality, country of permanent residence, date of birth, and date of receipt of the application of the asylum-seeker.
The descriptive part of the proposal should contain the brief summary of the asylum-seeker's application.
The explanatory part should contain the circumstances of the case investigated by the Department, the grounds, as well as the provisions of the "Law on Political Asylum" and other laws, which the Department followed during the case examination.

8. The conclusion should contain the inference on granting or rejecting the foreign citizen's application for political asylum in the Republic of Armenia, where should be mentioned the grounds for the decision determined by the law, as well as the date of the proposal composition.
The proposal signed by the head of the Department is presented to the President of the Republic of Armenia in accordance with the established procedure.

9. After the decision (granting or rejection of the political asylum status) of the President of the Republic of Armenia the Department:
a) separates the personal file of the asylum-seeker and keeps it in the files of the persons granted political asylum, if the President of the Republic of Armenia made a decision on granting political asylum;
b) separates the personal file of the asylum-seeker and keeps it in the files of the persons rejected political asylum, if the President of the Republic of Armenia made a decision on rejecting political asylum.
