A LAW TO REPEAL AND REPLACE THE PASSPORT LAW [Cap.119]
ENACTED by the Legislature of the Cayman Islands
1. Short Title and commencement.
This Law may be cited as the Passport Law, 1974 and shall come into operation on a day to be appointed by the Governor by Government Notice published in the Cayman Islands.
2. Interpretation.
In this Law -
"Governor" means the Governor in Council and any person authorised to act on his behalf for the purpose of this Law;
"passport" means a document, issued to a person by the competent authority of any State, authorising the holder to travel outside that State to the extent and during the period therein provided.
3. Governor may issue passports.
It is lawful for the Governor to issue or renew to any person a passport valid for a total period or periods not exceeding ten years in all from the date of issue.
4. Passports.
Passports issued by the Governor shall be in such form or forms as the Governor may from time to time determine.
5. Fee for issue of a passport.
There shall be charged upon the issue of and renewal of a passport such fees as may be prescribed and the payment of such fees shall be evidenced by adhesive or embossed stamps issued under the Post Office Law which shall be affixed or endorsed upon the relevant passport.
6. Regulations.
The Governor may make regulations prescribing -
(a)forms of application for passports;
(b)fees to be charged for the issue and renewal of passports;
and for the general administration of this Law.
7. Penal.
Whoever in respect of any passport -
(a)forges, alters or tampers with the same; or
(b)is found in unlawful possession thereof; or
(c)on finding the same neglects or fails to send such passport to the Chief Immigration Officer; or
(d)falsely holds himself out as the rightful owner thereof; or
(e)by any false representation procures or obtains or attempts to procure or obtain the issue of the same to himself or to any other person; or
(f)parts with the possession of the same to another person without lawful authority or for an unlawful purpose; or
(g)destroys, makes away with or by wilful neglect allows any other person to obtain possession of the same; or
(h)not having actual personal knowledge of the applicant for a passport makes any declaration verifying the declaration of such applicant or vouching the fitness of such applicant to receive a passport or to make any such declaration merely on information gained from the applicant or from any other person; or
(i)contravenes any regulation,
is guilty of an offence and is liable on summary conviction to imprisonment with or without hard labour for a period not exceeding one year or to a fine not exceeding one thousand dollars or both.
8. Repeal of Cap. 119.
The Passport Law is hereby repealed.
