Information on the acquisition of Ghanaian citizenship through birth, marriage or residence can be found in Response to Information Request SLE17030.E of 10 May 1994 as well as in the DIRB's April 1996 Contextual Information Package: Ghana, both of which are located in your Regional Documentation Centre.

As indicated in Response to Information Request SLE17030.E, provisions for the acquisition of citizenship through birth can be found in Article 2 of the 1992 Ghanaian constitution (Kludze May 1993, 32). Article 7 of the same constitution contains information on residency conditions, and Article 8, information on dual citizenship (ibid., 32-34).

The Nationality Act of 1971, included in the April 1996 Contextual Package: Ghana, also contains information on provisions for the acquisition of citizenship through birth, marriage and residency (Ghana 1971).

A representative of the High Commission for the Republic of Ghana in Ottawa stated during a telephone interview on 11 July 1996 that no applicable amendments to the 1992 Ghanaian constitution have been made and that to their knowledge the 1971 Nationality Act is still in effect, although the 1992 constitution should be considered as the most up-to-date source.

This Response was prepared after researching publicly accessible information currently available to the DIRB within time constraints. This Response is not, and does not purport to be, conclusive as to the merit of any particular claim to refugee status or asylum.
