A facsimile sent to the DIRB on 10 December 1996 by the executive director of the Albanian Helsinki Committee in Tirana states:

A person who returns to Albania after living abroad following his desertion from military service or border guard is punished according to the Criminal Code of this country up to 5 years imprisonment (Article 33 of the Criminal Code).

Please note that the executive director was asked the following question: What is the current penalty administered to a person who returns to Albania after living abroad following his desertion from military service or border guard duty in 1992?

In a telephone interview on 18 December 1996, the executive director stated that the criminal code mentioned in the 10 December 1996 facsimile is the military criminal code that was approved in November 1995.

This Response was prepared after researching publicly accessible information currently available to the DIRB within time constraints. This Response is not, and does not purport to be, conclusive as to the merit of any particular claim to refugee status or asylum.
