A petition for writ of certorari to the United State Court of Appeals for the Ninth Circuit was granted by the Supreme Court of the United States, which vacated the judgement and remanded the case to the United States Court of Appeals for the Ninth Circuit for further consideration in light of Gonzales v. Thomas, 547 U.S. ___, 126 S. Ct. 1613, 164 L. Ed. 2d 358 (2006).
