A large increase in migrant arrivals on the Spanish mainland by sea followed a policy of summary returns and reinforced controls at Spain’s land border with Morocco in its North African enclaves. In December 2016, the EU Court of Justice ruled that a 2013 Spanish Supreme Court judgment preventing consumers from suing banks for interest paid on mortgages under rules subsequently declared unlawful was incompatible with EU consumer protection laws, a major victory in legal challenges to unfair mortgage terms. Spanish counterterrorism laws include overly broad charges of glorification of terrorism and allows for incommunicado detention, despite repeated abolition calls.
