Please find attached the list of "category one" persons [those suspected of organizing and planning the 1994 genocide] wanted by the Rwandan authorities, which was sent to the Research Directorate by the Rwandan Department of Justice and Institutional Relations.

Information on the persons wanted by the International Criminal Tribunal for Rwanda (ICTR) was limited among the sources consulted by the Research Directorate. A 9 August 2003 report by Radio France international (RFI) quoted the ICTR Prosecutor, speaking before the members of the UN Security Council, as saying that [translation] "82 people have been charged by the ICTR to date, 65 of whom were arrested and 17 of whom are still at large." However, this source did not provide the names of the 17 people who had not been arrested yet.

Citing an ICTR news release, an Agence France Presse (AFP) article indicated that Juvénal Rugambarara, [translation] "a former Rwandan mayor prosecuted for genocide, was arrested in Uganda and transferred on Wednesday [13 Aug. 2003] to the International Criminal Tribunal for Rwanda (ICTR)" (14 Aug. 2003), bringing the number of arrests to 66 (ICTR 13 Aug. 2003). Information on the names and status of the 66 people who have already been arrested by the ICTR can be found on the Internet site of the Tribunal (ibid.).

In addition, the Internet site of the US Rewards for Justice Program (RFJ) provides a list of 13 people wanted by the ICTR for participating in the 1994 Rwanda genocide (United States n.d.). Only three names on this list are also on the ICTR list of the 66 people who have already been arrested (ibid.; ICTR 13 Aug. 2003). The names of the other people still at large can be consulted on the Internet site of the US Rewards for Justice Program (United States n.d.).

This Response was prepared after researching publicly accessible information currently available to the Research Directorate within time constraints. This Response is not, and does not purport to be, conclusive as to the merit of any particular claim to refugee status or asylum.
