According to a representative of the British High Commission in Ottawa, a child born in Hong Kong of Indian parents who have no status in Hong Kong has a right to Hong Kong and British citizenship only if he was born before 1 January 1983 (9 Dec. 1993). If the child was born after 1 January 1983, he does not have the right to either Hong Kong or British citizenship (ibid.). Please find attached a copy of the British Nationality Act of 1981 and a copy of a booklet on British citizenship.
This response was prepared after researching publicly accessible information currently available to the DIRB within time constraints. This response is not, and does not purport to be, conclusive as to the merit of any particular claim to refugee status or asylum.
