The Minister of Justice,

Given the Fundamental Law of the Republic of Rwanda, in particular the Protocol of Agreement of October 30, 1992, on Power sharing, in Article 16,6°,

Given the Law of February 23, 1963, establishing the Code of a Criminal Procedure, as amended in particular Article 113;

Given the Decre-Lawn n°21/77 of August 18, 1977, establishing the Penal Code, in particular Article 29;

After due consideration, and adoption by the Cabinet meeting in its session of May 14, 1997;

ORDERS:

Article one

The execution of a death sentence shall be carried out on premises of the prison where the condemned person is detained or in other determined by the Minister of Justice.

The execution shall be carried out in public or in camera.

(Amended by Ministerial Order No 23/11 of 21 April 1998).

Article 2

The time of the execution shall be determined by the Public Prosecutor's Office in charge of the execution.

However, the execution shall not be carried out before 5 A.M. nor after 6 P.M..

Article 3

(repealed by Ministerial Order No 23/11 of 21 April 1998).

Article 4

No person shall with any devices film, photograph or record an execution of death sentence.

Article 5

All existing ministerial provisions contrary to this Ministerial Order are repealed.

Article 6

This Ministerial Order comes into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
