On the basis of Art. 94 sec. 2 of the
§ 1
The ordinance specifies the amount of fees collected in Poland for the issuance of a temporary or permanent residence card, travel document, temporary travel document, travel document specified by the Geneva Convention, and temporary certificate of the alien's identity, the course of payment, conditions and scope of discount and exemption from payment, increase of fees in the case of bearing responsibility for the document's loss or damage, and documents required to obtain the right to discount and exemption from payment.
§ 2
A fee in the amount of 600 zl shall be collected for the issuance of a permanent residence card.
§ 3
A fee in the amount of 400 zl shall be collected for the issuance of a temporary residence card.
§ 4
A fee in the amount of 500 zl shall be collected for the issuance of a travel document.
§ 5
1. No fee shall be collected for the first issuance of a travel document specified by the Geneva Convention.
2. A fee in the amount of 20 zl shall be collected for every next issuance of the document specified in sec. 1 above.
§ 6
A fee in the amount of 50 zl shall be collected for the issuance of a travel document which entitles the alien to a single crossing of the border.
§ 7
1. Discount fees for the issuance of a temporary or permanent residence card, travel document, travel document specified by the Geneva Convention or temporary travel document in the amount of 50% of the fees specified in § 2 through 4, § 5 sec. 2, and § 6 shall be collected from:
1) aliens who apply for the exchange of the document in the period of its validity due to the following circumstances:
a) change of family name, name or other data which are written in the document;
b) change of the alien's appearance which might render the establishment of his/her identity difficult;
c) lack of space in the currently held document for the entry of new data that must be written in the document, or new stamps;
2) aliens who are in a difficult material situation, and discount fees are supported by reasons of public good;
3) aliens who learn or study in the Republic of Poland.
2. A discount fee for the issuance of a permanent residence card relating to the card's exchange as specified by Art. 110 sec. 2 of the June 25, 1997 Aliens Law (Journal of Law, No. 114, item 739) amounts to 5% of the fee specified in § 2.
§ 8
1. No fees shall be collected for the issuance of documents specified in § 1 from the following categories of people:
1) minor aliens who were below 16 years of age on the day of lodging the application;
2) aliens who applied for the exchange of the documents due to the documents' technical faults.
2. No fees shall be collected for the issuance of the first temporary residence card from an alien who has been granted the refugee status in the Republic of Poland.
3. No fees shall be collected for the issuance of a temporary travel document in the case of an expulsion from the territory of the Republic of Poland of an alien who holds no passport document.
4. No fees shall be collected for the issuance of a temporary certificate of alien's identity.
§ 9
1. Fees in the amount of twice the fees specified in § 2 through 4, § 5 sec. 2, and § 6, and no less than 50 zl, shall be collected for the issuance of new documents specified in § 1 before the expiry of the currently held ones, if the holder bears responsibility for the document's loss or damage.
2. Fees in the amount of three times the fees specified in § 2 through 4, § 5 sec. 2, and § 6, and no less tha 250 zl, shall be collected for the issuance of new documents specified in § 1 of the Ordinance before thexpiry of the currently held ones in the case of another occurrence of the circumstances specified in sec. 1 above.
§ 10
1. Fees shall be collected by the agency authorized to issue a document specified in § 1.
2. Fees shall be paid at the cashier's desk of the agency authorized to issue the document, or transferred t the agency's bank account, including the costs of transfer.
3. Documents which confirm the right to a discount or exemption from payment are, in particular:
1) appropriate social assistance agency's certificate to confirm permanent participation in a social assistance program;
2) certificate from a school or university the alien attends;
3) a copy of a minor alien's birth certificate.
§ 11
1. Decision on the increase of fees specified in § 9 shall be rendered by the agency authorized to issue the document.
2. Decisions on discounts and exemption from payment specified in § 7 through 8 shall be made by agencies authorized to issue the document, upon the alien's documented motion.
§ 12
The Ordinance enters into force on the day it is announced.
