The Government of State of Eritrea has not acceded to the 1951 Convention Relating to the Status of Refugees, nor its 1967 Protocol. In April 2012, the Government signed, but has not yet ratified, the 1969 OAU Convention on the Specific Aspects of Refugee Problems in Africa.
Eritrea currently does not have a comprehensive and cohesive domestic legislative framework to specifically regulate refugee matters and State-owned refugee status determination procedures are not yet in place.
GoSE recognizes Somali refugees on a prima facie basis based on informal and unwritten administrative procedures. At present, access to asylum for asylum seekers who do not originate from Somalia is practically not open.
The State of Eritrea has hosted Somali refugees for two decades granting them an overall satisfactory level of protection and access to basic rights.
